FAIR EMPLOYMENT

WAGES

Minimum Wage Rate in the U.S. Virgin Islands is $10.50 per hour.

Time and a half of the regular hourly rate must be paid for all hours worked over 8 hours each day and for over 40 hours in any work week including any hours worked on the 6th and 7th consecutive day of work. In the tourist and restaurant industries, overtime must by paid on the 7th consecutive day: the 6th consecutive day is exempted if the employee does not exceed 40 hours.

TIPPED WAGES

Employees that work for tips must be compensated no less than $4.20 per hour in direct wages and receive at least $10.50 per hour with wages and tips combined.

CHILD LABOR LAWS UNDER THE FLSA

Employers are generally subject to both state child labor laws and the federal child labor provisions of the Fair Labor Standards Act (FLSA), 29 U.S.C. 212(c), and the FLSA regulations at 29 CFR Part 570. Certain provisions of US Virgin Islands law may be less restrictive than federal law, and employers covered by the FLSA that only follow a less restrictive provision of US Virgin Islands law will be in violation of federal law. See 29 U.S.C. 218(a). For more information on federal child labor law, please visit the U.S. Department of Labor’s Wage and Hour Division Website at www.dol.gov/whd.
