PRELIMINARY INJUNCTION ON THE FINAL RULE – OVERTIME REGULATIONS IMPLEMENTATION STAYED UNTIL FURTHER NOTICE

Labor Commissioner Catherine A. Hendry, Esquire, wishes to notify all Virgin Islands employers and the general public that on November 22, 2016, U .S. District Judge Amos L. Mazzant ruled in a preliminary injunction that the United States Department of Labor overstepped its authority by raising the salary cap for overtime for workers who earn $455 per week or $23,660 per annum. The new rule would raise the salary cap for overtime to $913 per week or $47,476 per annum and include two other eligibility tests.
